PAGE PAGE 18 大数据时代消费者隐私保护的现状与启示 摘要：随着物联网和云计算的出现，我们开始步入了大数据时代，在这一时代中，我们日常所行所思都会被毫无保留的记录在互联网上，而这些原来不被我们所重视的互联网上的消费者隐私数据开始具有庞大的利益，这也使得越来越多的企业开始利用消费者隐私保护意识还不强的现状，无度地在消费者身上攫取利益，这就促使了我们对于这大数据时代消费者隐私保护的现状与启示一文的研究。 目前我国还没有较为完善的对于消费者隐私保护的专门法律，在法律层面我国还处在较为落后的地步。同样因为互联网发展到现在的时间还短，在突然暴增的利益面前，企业也没有做好相对的准备，这也使得行业内企业对于消费者隐私保护意识的不足，没有形成良好的企业自律规则。 欧盟国家和美国在互联网上的发展领先我国一大步，双方都形成了较为适合自身的体系来满足隐私保护的需求。欧盟主要是以法律为基础的立法保护模式，美国则是采用自我约束模式，这两个模式从政府和企业层面去解决隐私保护问题，都取得了较好的成果。所以我国可以借鉴他们的模式，并结合自身国情，采取以立法为主，企业自律辅助发展的综合性模式，来满足我国消费者对于隐私保护的需求。 关键词：大数据隐私保护企业自律 The current situation and Enlightenment of the era of big data consumer privacy protection Abstract:With the advent of the internet of things and cloud computing, we started to enter the era of big data, in this day and age, we think the daily line will be without reservation record on the internet, began to have huge benefits, it also more and more enterprises begin using situation of consumer privacy protection awareness is not strong, excessive on consumers to grab the interest, which prompted us to the present situation and enlightenment of the era of big data consumer privacy in the research.
