PAGE PAGE 17 基于银信合作理财业务监管问题研究 摘要：近年来，银信合作业务在我国发展迅速，但其快速发展的同时却带来了一系列问题，监管部门也为此频频出台相关政策，调整和规范银信合作的发展。本文采用调查研究，从银信合作理财业务监管的必要性着手，对银信合作业务的规模，发展速度，风险,下监管方面的不足进行分析，得出了结论。监管部门需要抓紧完善法律法规，在完善法律法规时需要有一点的提前意识，不要每次都等到问题出现时才去完善政策。这些都可以参考西方发达国家的银信产品的发展过程。而且监管部门在对待银信合作业务的时候要松紧结合，在发展阶段要采取适当宽松的政策扶持，在发展到一定阶段，发现问题的时候就要采取严格的措施去消除问题。调整业务，要保护好投资者的利益。 关键词：银信合作，监管，信托 Research on the supervision and management of silver trust cooperative financial services Abstract: In recent years, the cooperation between trust and bank in our country is developing rapidly, but its rapid development, it has brought a series of problems, regulators this frequently introduced relevant policies, adjust and standardize the bank letter of cooperation development. Keywords: Silver letter cooperation, supervision, trust 一、引言 银信理财合作业务是银行与信托公司进行合作，把通过设立理财计划向投资者募集资金，交给信托公司，由信托公司来发放贷款。它绕过央行限制的商业银行的贷款额度。在银信理财产品中，银行理财资金的收益来源于信托收益。截至2014年第二季度末，银信理财合作规模余额约为2.67万亿元，占信托业总规模的21.41%。我国的商业银行约在2004年开展理财业务，但是直到2007年，银信合作理财业务才慢慢开始发展，而2010年开始，银信合作的理财业务呈现井喷式发展，出现了多种多样的理财产品。据相关记载，工商银行、建设银行等30家商业银行与中信信托、中诚信托等24家信托公司进行合作，共发行了631只银信合作理财产
