PAGE PAGE 26 集体经营性建设用地入市流转的法律冲突与政策风险 摘要：研究目的：十八届三中全会提出允许农村集体经营性建设用地入市流转，意在盘活原粗放利用甚至闲置的农村建设用地，然而在实际操作中，集体经营性建设用地入市流转面临着许多困境，本文希望通过实践案例的剖析，理清入市流转难点，提出解决方法。研究方法：采用文献研究法，结合各地实践情况进行综合分析。研究结果：现行的相关法律无法满足集体经营性建设用地入市流转的实际情况，并与后期出台的政策存在较大冲突。土地流转后的收益分配及纠纷解决机制亦缺乏规范。研究结论：修改完善法律制度，建立农村社会保障制度，提高农民入市参与度；加强科学合理设计下的实践，从局部试点逐渐扩展到全国地区。 关键词：集体经营性建设用地；土地政策；法律政策冲突 The legal conflicts and policy risks of construction land into the market Abstract: Research purposes:?the Third Plenary Session of the 18th CPC Central Committee?allows operation of rural collective construction land to transfer, intended to revitalize the the rural construction land which Original extensive use and even idle.However,in actual operation,collective management of construction land into circulation is confronted with many difficulties, we hope that through the analysis of cases in practice, clarifying market turnover difficulties, putting forward solutions. Results: the current law can not meet the actual situation of the collective management of construction land circulation, there is a big conflict with the late introduction of the policy. The distribution of income after the land transfer and dispute settlement mechanism is the lack of standard. Conclusion: the revision and improvement of the?legal system, the establishment of rural social security system,?improve the participation of farmers into the market; to strengthen the practice of scientific and rational design, from the local pilot gradually expanded to the whole country. key word：Collective construction land; land policy; conflict of laws and policies 一、引言 改革开放以来，我国经济迅速发展，城镇化和工业化水平都有了较大的提高，但城乡差距不断加大、城乡二元结构明显等问题愈演愈烈。城镇化率的提高伴随着农业人口的骤减，不少农村出现了废耕现象，不仅影响了农民权益，阻碍了农村发展，更无法释放改革红利，抑制了国家经济增长潜力。基于此，2013年召开的十八届三中全会提出“建立城乡统一的建设用地市场。在符合规划和用途管制前提下，允许农村集体经营性建设用地出让、租赁、入股，实行与国有土地同等入市、同权同价[1]。”将占农村土地数量较小部分的集体经营性建设用地释放出来，允许其入市流转是一种科学合理的尝试之举，能为以后更大范围的农村
