认罪认罚从宽制度研究3.docx

广州大学松田学院2016届毕业论文（设计） 摘 要 在全面依法治国和司法改革的背景下，全国人民代表大会在许多地区尝试实施认罪认罚从宽制度，是由于一部分的刑事案件案多人少，十分不符合社会需求，司法资源的配置不完善，诉讼效率低下。在我国的司法改革中，对该制度的研究是对一项全新的制度的发展和完善，具有跨时代的价值和意义。对其的研究，对司法实践具有重要意义。虽然在实践中已对认罪认罚从宽制度的构建，但尚有许多问题值得研究。本文的主文分为五章：第一部分是阐述认罪认罚从宽制度的概念，界定“认罪”、“认罚”、“从宽”的内涵以及分析它们之间的关系。第二部分是讨论认罪认罚从宽制度与坦白、自首的关系。第三部分是介绍域外与认罪认罚从宽制度相似的制度，比较它们之间的异同之处，总结域外制度带给我们的启示。第四部分是分析现行制度存在问题。第五部分是对现行制度的完善。 关键词： 认罪，认罚，从宽，完善 ABSTRACT In the context of the comprehensive rule of law and judicial reform, the National Peoples Congress (NPC) has tried to implement a lenient system of guilty admission and punishment in many regions. This is due to the fact that some criminal cases have few cases, which do not meet the needs of the society, the imperfect allocation of judicial resources and the low efficiency of litigation. In the judicial reform of our country, the study of this system is the development and improvement of a new system, which has the value and significance of The Times. The study of it is of great significance to judicial practice. Although the establishment of the lenient system has been established in practice, there are still many problems worth studying. The main text of this paper is divided into five chapters: the first part is to explain the concept of the leniency system, define the connotation of admission of guilt, admission of punishment, leniency and analyze the relationship between them. The second part is to discuss the relationship between confession and surrender. The third part is to introduce the similar systems of the extraterritorial system and the lenient system of confession and punishment, compare the similarities and differences between them, and summarize the enlightenment brought by the extraterritorial system. The fourth part is to analyze the existing problems of the current system. The fifth part is the improvement of the current system.
