浅论我国婚姻法关于夫妻共同财产分割的规定及其完善 　　【摘要】现代社会越来越发达，人们的财富累计也是越来越多。但是伴随着的也是越来越高的离婚率。针对于这种现象，我国一直有在更新和修订婚姻法，其目的就是为了保证夫妻双方的权益，不让某一方受到关于财产的侵害。在我国司法案例的实践中，夫妻双方就共同财产问题有很多的牵扯和纠葛，当夫妻双方感情破裂需要离婚时，双方的共同财产分割问题更为棘手和麻烦。夫妻共同财产分割的的纠葛对于很多夫妻共同财产分割的理论发起了巨大的挑战，不得不迫使夫妻共同财产分割的法律法规得到调整和相应地补充。但是，中国离婚夫妻共同财产分割仍存在一些棘手问题。 　　【关键词】婚姻法;夫妻财产;规定完善 　　ontheprovisionsandperfectionofthemarriagelawofourcountryconcerningthedivisionofthejointpropertyofhusbandandwife 　　[abstract]withthedevelopmentofmodernsociety，peopleswealthisalsoincreasing.however，thedivorcerateisalsoincreasing.butitisalsoaccompaniedbyarisingdivorcerate.inresponsetothisphenomenon，ourcountryhasbeenupdatingandrevisingthemarriagelaw，thepurposeofwhichistoensuretherightsandinterestsofbothhusbandandwifeandtopreventonepartyfrombeinginfringeduponbyproperty.inthepracticeofjudicialcasesinourcountry，bothhusbandandwifehavealotofinvolvementanddisputesontheissueofcommonproperty.whentherelationshipbetweenhusbandandwifebreaksdownanddivorceisneeded，thedivisionofcommonpropertybetweenbothpartiesismoredifficultandtroublesome.theentanglementsofthedivisionofhusbandandwifescommonpropertyhaveposedgreatchallengestomanytheoriesofthedivisionofhusbandandwifescommonproperty，forcingthelawsandregulationsgoverningthedivisionofhusbandandwifescommonpropertytobeadjustedandsupplementedaccordingly.however，therearestillsomethornyproblemsinthedivisionofthecommonpropertyofdivorcedcouplesinchina. 　　[keywords]marriagelaw;maritalproperty;perfectregulations 　　我國是很早就存在了婚姻法的，但是随着国家的进步，婚姻法也在不断的发展和更新。随着婚姻法对夫妻婚姻法的立法和司法解释都在不断发展和更新，其中的个人化，具体化和科学化的特点越来越突出。夫妻之间的共同财产的范围缩小，个人财产的范围扩大，规则越来越精细和完善，并且具有广泛的可操作性。就相关立法的完善而言，公平分割的原则被用来取代平等分割原则，婚姻中共同财产的划分，知识产权的收入范围，以及“家务补偿制度”更好地反映了诚信是一种“无形财产”。 　　1夫妻共同财产的定义 　　夫妻财产的定义通常是指婚前财产的所有权制度和婚姻关系中婚后取得的财产，都算为夫妻的共同财产。中国目前的婚姻财产制度是合法财产制度和商定财产制度的结合。法定婚姻财产制度是法律规定的婚姻财产制度。强制性申请是法定婚姻财产制度的一个突出的法律特征，不同于商定的财产制度，配偶双方财产制度达成一致。丈夫和妻子同意财产制度是指允许当事人在婚姻关系中以协议的形式就夫妻所有权，使用，收入和处置达成协议的制度。排除制定法定共同财产的制度。 　　1.1合法夫妻的义务以及权利 　　中国的“婚姻法”规定，夫妻在家庭中享有同等地位。主要内容是夫妻在居住和生活
