PAGE 8 论校园欺凌中刑事责任年龄的下调——以刑法修正案十一为中心 摘 要 　　2020年底，刑法修正案（十一）通过，其中关于故意杀人罪与故意伤害罪刑事责任年龄附条件下调的规定，突破了我国以往“一刀切”的刑事责任年龄制度。 　　鉴于我国校园欺凌现状不容乐观，同时对校园欺凌行为的非刑罚规制与刑法规制机制均不完善，于是笔者从刑法修正案（十一）的规定出发，阐述对校园欺凌进行刑法规制的必要性。 　　文章共五部分。第一部分为前言，对刑法修正案（十一）进行简单的评价并就相关学术研究作简要回顾。第二部分为对未成年人犯罪以及典型未成年人犯罪案例的剖析，证明未成年人由于生理、心理机能发育尚未完成而处于犯罪多发期。第三部分为校园欺凌的现状概述，目前国内校园欺凌现象依旧多发，且学校等方面现有的防治措施远远不足以遏制校园欺凌的发生。第四部分是校园欺凌的刑法规制可行性论证；最后一部分为小结。 　　尽管我国对未成年人犯罪持宽容态度，但宽容不等同于纵容。对校园欺凌进行刑法规制，是对潜在的校园欺凌者的有效震慑，同时亦是对被欺凌方合法权益的保护，既体现了刑法的规制机能，亦体现了其保护机能。关键词：未成年人犯罪 校园欺凌 责任年龄 制度完善 　　Discussion on lowering the age of criminal responsibility in campus bullying —— Focus on the 11th criminal law amendment Chen chunming 　　　Abstract：The 11th criminal law amendment has been vote passed at the end of 2020, and what it had stipulated about the age of responsibility in the case of murder and malicious injury is a breakthrough in our previous one-off criminal policy. Because of the serious current situation of campus bullying in China, and the criminal and non-criminal ways to deal with it are both imperfect, I tried to tell about the necessity of criminal punishment for campus bullying, focused on the amendment. The essay is divided into five parts. The first part is preface, in this part, I’ll make a simple comment on the new amendment and a introduction about some related academic researches. The second part is analyses about juvenile delinquency and typical cases in order to prove that juveniles are in the crime prone period because of their incomplete physical and psychological development. The third part is an overview of the current situation of campus bullying. At present, campus bullying still occurs frequently in China, and the measures now available in schools are not enough to keep the occurrence of campus bullying down. The fourth part is a demonstration process of the feasibility of criminal law regulation on campus bullying. The last part is summary.
