未成年人犯罪前科消灭制度研究

摘要：我国立法向来秉持着教育为主、惩罚为辅的原则，来感化、挽救犯罪的未成年人。随着近年来未成年人犯罪事件频繁发生，我国立法必须加以重视，既要惩戒未成年人，让其迷途知返，又要注意措施得当，让其能够更好的重回社会，免遭歧视。

本文首先解释了何为未成年人犯罪前科消灭制度，以及该制度在全球各国实行的现状和具体效果。紧接着探讨该制度若在我国得以真正实行，会产生怎样的效果，是否会符合我国国情，得到社会大众的认可。最后从各个角度、各个方面综合考虑，为该制度的实行提出相关切实可行、符合实际运用的建议。

因为该制度并未在我国真正实行，但笔者认为借鉴国外先进立法经验，同时结合中国具体情况来构建该制度是具有深远意义的。立法和司法机关尤其要领头尝试、实践，为该制度在我国的实行积累宝贵经验。

Abstract:Chinaslegislationhasalwaysupheldtheprincipleofeducationfirstandpunishmentsecond,toinfluenceandsavethejuveniledelinquency.Withthefrequentoccurrenceofjuveniledelinquencyinrecentyears,Chinaslegislationmustbepaidattentionto,notonlytopunishminors,letthembacktothewrongway,butalsotopayattentiontoappropriatemeasures,sothattheycanbetterreturntosociety,fromdiscrimination.Thispaperfirstexplainswhatistheeliminationsystemofjuveniledelinquency,andtheimplementationofthesystemintheworldandthespecificeffect.ThenitdiscussestheeffectofthesystemifitcanbereallyimplementedinChina,andwhetheritcanmeetthenationalconditionsofourcountryandberecognizedbythepublic.Finally,fromallangles,allaspectsofcomprehensiveconsideration,fortheimplementationofthesystemputforwardrelevantfeasible,inlinewiththeactualapplicationoftheproposal.BecausethesystemisnotreallyimplementedinChina,buttheauthorbelievesthatitisoffar-reachingsignificancetolearnfromtheadvancedlegislativeexperienceofforeigncountriesandcombinethespecificsituationofChinatoconstructthesystem.Thelegislativeandjudicialorgansinparticularshouldtaketheleadintryingandpracticing,accumulatingvaluableexperiencefortheimplementationofthesysteminourcountry.
