残疾人劳动就业权的法律保护

摘要：相关资料显示，我国残疾人口是世界上最多的国家。到底要如何保障有劳动能力的残疾人就业，确保他们能够平等地参与到我们的社会生活中对全面实现小康生活的目标有着不可或缺的重要作用。帮助残疾人实现劳动就业的权利是帮助残疾人改善生活状态的基础，是解决社会矛盾的关键。因而，残疾人劳动就业这一问题亟待解决，他们的就业需求不容忽视。小康路上不能少了对残疾人生活的保障！

本文通过介绍选题背景和研究现状，以及运用比较研究方法、文献研究方法，案例分析法，归纳总结方法。提出本文的基本框架和方法。集中对残疾人劳动就业权基本理论中的定义、特性等内容以及我国目前残疾人就业劳动权存在的不足现状，对比国外优良的残疾人保障经验，结合我国目前基本国情，分析我国目前残疾人就业劳动权存在的具体问题。最后，结合现状，挖掘出我国在残疾人就业劳动权保障方面的对策。

Abstract:Accordingtostatistics,thereisthebiggestdisabledpopulationinChinaaroundtheworld.Howtoguaranteetheemploymentofdisabledpeoplewhoareabletoworkandtoensuretheirequalparticipationinoursociallifeplaysanindispensableroleinachievingthegoalofmoderatelyprosperousinallrespects.Helpingthedisabledtorealizetheirrighttoworkandemploymentisthebasistohelpthedisabledtoimprovetheirlivingconditionsandthekeytosolvingsocialcontradictions.Therefore,theproblemofemploymentofthedisabledneedstobesolvedurgently,andtheiremploymentneedsshouldnotbeignored.It’snotsupposedtoreducethesecurityofthedisabledinwell-offroad.

Thispaperintroducesthebackgroundandresearchstatesofthetopic,usingofcomparativeresearchmethods,literatureresearchmethods,caseanalysismethodsandsummarymethods.Thebasicframeworkandmethodsofthispaperareproposed.Focusonthedefinition,characteristicsandothercontentsofthefundamentaltheoryoflaborandemploymentrightofthedisabled,aswellastheactualityoftheemploymentrightsofthedisabledinChina.Comparetheexcellentexperiencesoflegalprotectionofthedisabledabroad,andanalyzethespecificproblemsexistingintheemploymentrightofdisabledpeopleinourcountry.Finally,combinewiththecurrentsituationandexcavatethecountermeasurestoprotecttheirrightfromharminourcountry.
