Thecarriershouldbeliableforloss,deficiency,deterioration,pollutionanddamageoftheinsuredfreight承运人从承运货物时起，至将货物交付收货人时止，对保价货物发生的灭失、短少、变质、污染、损坏承担赔偿责任，但由于下列原因造成的,承运人fromcarriageofthefreighttodeliveryofthefreight.不承担赔偿责任Butthecarriershallnotbeliableforanyofthefollowingcauses:一、保价责任范围与免责条款TheResponsibilitiesandExceptionsforValueInsuredRailFreight1.不可抗力1.Forcemajeure.2.货物本身的自然属性或合理损耗2.Naturalpropertiesofthefreightorreasonablewearandtear.3.托运人收货人或押运人的过错3.Mistakesmadebyconsigneesorescorts.知识点二保价赔偿与限额赔偿KnowledgepointⅡValueInsuredCompensationandLimitedCompensation

办理保价运输的货物按保价赔偿Insuredfreightshouldbecompensatedaccordingtotheinsuredvalueofthefreight.Accordingtotheactualloss,thecompensationshouldnotexceedtheinsuredvalueofthefreight.按照实际损失赔偿，最高不超过保价金额不受保价额的限制，按照实际损失赔偿thecompensationshouldbemadeaccordingtotheactuallosswithoutlimitsofinsuredvalue.二、保价赔偿Ⅱ.CompensationofInsuredFreightIfthelossiscausedintentionallyorcausedduetogrossnegligenceoftherailwaytransportenterprises,如果损失是铁路运输企业的故意或者重大过失造成的Incaseofpartialloss,compensationshouldbemadeaccordingtotheproportionofthelostfreightinthewholefreightmultiplyingtheinsuredvalue.部分损失时,按损失货物占全批货物的比例乘以保价金额赔偿Ifthecompensationfailstobepaidwithintimelimit,thestationshouldpaycompensationtotheclaimant.逾期未能赔付时,处理站应向赔偿要求人支付违约金知识点二保价赔偿与限额赔偿KnowledgepointⅡValueInsuredCompensationandLimitedCompensation
