生成式人工智能的著作权及其风险规避研究

摘要

人工智能进入更加智能的生成式时代，社会治理局面复杂多变，技术飞速发展与立法滞后性之间存在着

矛盾，新型纠纷不断涌现，现有法律体系难以覆盖新领域的社会治理困境，出现了无法可依的现象，科

技的发展倒逼法律的完善。其中，人工智能生成内容的著作权问题和侵权问题是必须面对的社会治理难

题，将人工智能生成的内容纳入著作权保护范围已经是时代趋势，且相关司法已经认定AIGC构成“作品”，

由使用人享有著作权，但在侵权问题上存在着不同的情况，在输入端，在不损害他人知识产权的情况下，

需要立法探索大模型训练数据输入的合法合理路径，在输出端，需要平台采取相关措施降低侵权风险，

否则一旦侵权，平台需要承担相应的侵权责任。

Theeraofartificialintelligencehasenteredamoreintelligentgenerativephase,withcomplexand

ever-changingsocialgovernancesituations.Thereexistsacontradictionbetweentherapiddevel-

opmentoftechnologyandthelaginlegislation,leadingtotheemergenceofnewtypesofdisputes.

Theexistinglegalsystemstrugglestocoverthesocialgovernancedilemmasinnewfields,resulting

inphenomenawherethereisnolegalbasis.Thedevelopmentoftechnologycompelstheimprove-

mentofthelaw.Amongtheseissues,thecopyrightandinfringementproblemsrelatedtoAI-
