甲方：

乙方：

甲方因单位业务需要，使用乙方（车牌）（私）汽车一辆，经双方协

商一致，达成协议如下：

一、使用期限：

乙方自_____年_____月______日起，将车辆交付给甲方使用，至

______年_____月______日收回。

二、使用方式：

甲方使用乙方汽车期间，乙方再将该车作为私车使用。

三、费用分摊：

（一）甲方承担对乙方汽车在业务范畴内进行使用所发生的一切费用，包

括汽油费、过路费、过桥费、停车费、费、正常保养（修）等日常费

用。

（二）甲方承担对乙方汽车使用期间的投保费用，包括交强险、车辆损失

险、盗抢险、自燃险、第三责任险。

四、风险承担：

（一）甲方在使用期内，承担乙方汽车发生的交通事故、失窃、毁损等风

险，以下情况除外：

1、乙方《人民道路条例》驾驶汽车发生交通事

故；

2、乙方故意捏造汽车失窃、制造汽车毁损情况的。

五、协议终止及解除：

（一）如甲、乙双方在使用期届满时未达成延长使用期的协议，则该协

议自动终止。

（二）因车辆状况导致车辆无法正常行驶时，甲方有权解除协议。

（三）双方特殊需提前解除协议，需提前两周告知对方。

六、其他：

（一）本协议未尽事项由双方协商解决。

（二）本协议自甲、乙双方签字（盖章）后生效。本协议一式两份，由甲、

乙双方执一份，具有同等法律效力。

（三）有关协议的一切争议，双方经协商解决未能达到一致的，任何一方

可向甲方乙方所在地的提出。

scopeofbusiness,includingfuelcosts,tolls,bridgefees,parkingfees,cleaningfees,

regularmaintenance(repairs),andotherdailyexpenses.

(2)PartyAshallbeartheinsurancecostsforthevehicleduringitsuse,including

compulsorytrafficinsurance,vehicledamageinsurance,theftinsurance,spontaneous

combustioninsurance,andthird-partyliabilityinsurance.

IV.RiskBearing:

(1)Duringtheusageperiod,PartyAshallbeartherisksassociatedwithtraffic

accidents,theft,anddamagetoPartyBsvehicle,exceptforthefollowingsituations:

1PartyBviolatestheRoadTrafficSafetyLawofthePeoplesRlicofand

causesatrafficaccident;

2PartyBintentionallyfabricatesthetheftofthevehicleorthe

damagetothevehicle.
