There do exist many problems in the process of implementing and improving the system, among which, the legal property of the carbon emissions issues, trading market regulatory issues and legal risk prevention issues in theprocess ofbuilding the carbon emissions trading system are the most urgent andmost important issues.Based on the problems mentioned above, I analysis and personally consider that the confirmation of carbon emission rights is the premise and legal market regulation issues is the external security for the system to function smoothly. Besides, by tracing to the source, I try to figure out what are the sources of the legal risks prevention in the process of establishing Chinas carbon emissions trading system.
