行业协会自律行为的内在困境研究——以广东鞋业厂商会为例.pdfVIP

摘要 行业协会是行业自律重要的组织者和实施者，但是我国行业协会自律行为方 面的表现差强人意。本文通过对广东鞋业厂商会自律行为的现状进行分析，发现 广东鞋业厂商会自律行为存在的最大问题是自律行为欠主动。之所以出现这个问 题部分原因是由于广东鞋业厂商会的自律行为存在内在困境，此困境表现为三个 方面：第一，行业协会在制定和实施行业自律规则上存在困难；第二，行业协会 自律行为对会员缺乏较强的制约性；第三，信任机制目前在行业协会自律行为中 发挥的作用有限。通过对广东鞋业厂商会的自律行为进行进一步分析，本文认为 行业协会的性质特征与自律形式相互作用形成了行业协会自律行为内在困境的 根源：一方面，我国行业协会较宽的组织边界造成了其制定和实施行业自律规则 的困难；另一方面，行业协会的自组织性和次生性特征决定了其在自律行为中缺 乏对会员较强的制约性；最后，行业协会会员的逐利性使信任机制在行业协会自 律行为中发挥的作用有限。 关键词：行业协会；自律行为；内在困境 I Abstract Industry associations are important organizers and executors in terms of industry self-regulation. However, the acts of their self-regulation are far from perfect. By analyzing the current situation of The Association of Guangdong Shoes Manufacturers,we find that lack of initiative is the biggest problem in terms of industry self-regulation of The Association of Guangdong Shoes Manufacturers. The problem is partly caused by the internal predicament of the Self-regulation of The Association of Guangdong Shoes Manufacturers . The internal predicament mainly manifests in three aspacts. Firstly, it is difficult for the Industry Association to formulate and implement Industry Self-regulation rules. Secondly, industry self-regulation behavior has no binding force to members of Industry association. Thirdly, trust mechanism plays a limited role in the industry self-regulation behavior. According to a further analysis on the self-regulation behavior of the Association of Guangdong Shoes Manufacturers, we can draw a conclusion that the interaction of the organizational characteristics of industry associations and self-regulation modality are the root of the I
