论 文 摘 要 本文从归责原则的一般原理着手开始研究，到归责原则的本质属性，从中勾 勒出国家赔偿法中归责原则的理论渊薮和自有特征。运用历史分析的方法来看我 国国家赔偿法归责原则之历史沿革，结合司法实践与法学理论，分析现有体系下 的国家赔偿法归责原则之不足，其中存在的主要问题是行政赔偿领域中归责原则 单一、违法归责原则弹性不够、违法归责原则导致的赔偿范围有限以及在司法赔 偿领域中的有条件的结果归责原则导致实施过程中出现条款滥用情形。为更好的 运用归责原则来解决司法、行政实践中存在的问题，并结合域外国家赔偿法归责 原则的有益经验，得出我国应针对本国的实际情况、顺应国际潮流构建多元化的 归责原则体系，并且，应该是在遵循国家赔偿法归责原则应有的价值取向的基础 上，构建出适合我国国情的以违法和过错责任原则为主，其他归责原则为辅的归 责原则体系。 关键词：归责原则，国家赔偿，违法归责原则，过错归责原则，结果归 责原则               ABSTRACT According to the general principle of the criterion of liability,essential attribute of t he criterion of liability will be achieved,and the State Compensation Law of the criteri on of liability theory hotbed and its own characteristics will be clear. With historical p rinciple, the historical evolution of the State Compensation Law of the criterion of lia bility will be summerized and the main problems will be analysed, that is, the lack of t he criterion of liability. The criterion of liability in the field of executive compensatio n, for instance, is too sole; the flexibility of Illegal criterion of liability is not enough; t he scope of compensation caused by the Criterion of Liability is too limited and condi tional results in principle lead to the field of judicial compensation that may arise in th e implementation of terms of abuse. In order to solve problems in practice, combined with useful experience attributable to the principle of extraterritorial State Compensati on Law, that our country should focus on their actual situation and follow the internati onal trend attributable to the principle of building a wide range of syste
