论我国外资法的完善 ——以应对金融危机为视角 摘要：金融危机爆发以来，我国外资工作主要面临着引资困难、外资趋向 “垄 断”、外资影响国家经济安全这三个方面的挑战。而现阶段，我国在这三个方面 的法律法规都存在亟待完善的地方：首先，我国外资法律的环境存在缺陷；其次， 我国缺乏规制外资“协同行为”的法律制度；最后，我国国家经济安全审查法律 制度还没有完全建立。通过比较分析，发现美、韩等国的相关法律制度已经相当 成熟和完善，并且有许多值得我国借鉴的地方。因此，我们应该从我国的基本国 情出发，借鉴国外先进的法律经验，进一步优化我国的外资法律环境、构建和完 善我国“反协同行为”以及国家经济安全审查的法律制度，以更好的应对金融危 机。 关键词：外资法；金融危机；制度完善 I ON THE IMPROVEMENT OF OUR FOREIGN INVESTMENT LAW ——TO COPING WITH THE FINANCIAL CRISIS Abstract: Since the financial crisis, the main difficulties we have faced are the shortage of foreign investment, the tendency to “monopoly” and the bad influence on security of our national economy. At present, our country’s legal regulations are not perfect in these three aspects: at first, the surrounding of our foreign investment law is far to perfection; secondly, we are lack of the law system which can regulate foreign cooperative behavior”, finally, the review system of economic security is still not completely established. Through the comparative analysis, we have found that America, South Korea and other countries which have relative mature and perfect legal system in these fields, and there are many experiences are worthy of our reference. Therefore, we should start from Chinas basic conditions, and learn from foreign advanced experiences, optimize the foreign investment law ’s environment. We also should construct and perfect the system which regulate the “cooperative behavior and review the economic security. All these things are able to help us to cope with financial crisis well.
