广东商学院硕士学位论文  摘  论政府权力的社会制约——国家社会二元化下的宪政实践 要  政府权力的社会制约是指在国家社会二元化的前提下，通过特定的民主原则和法 定程序配置社会权利资源，优化社会权利结构，组织来自社会领域的组织、力量规范 政府权力的运行程序，提高政府权力的运行效益，实现国家与社会的沟通与合作。政 府权力社会制约的逻辑起点是政治国家与市民社会的分离，政制渊源是人民主权学说， 理论支柱是社会制约权力理论。美、英、德、法等现代西方宪政国家主要是通过组成 利益集团、压力集团、院外集团实现社会对政府权力的制约，根据其所强调的竞争性 和合作性，可归为多元主义模式与法团主义模式。中国政府权力的社会制约在历史上 受到传统的社会政治经济文化状况的阻碍，在当代的发展也经历了四个不同的阶段。 结合当今社会政治经济文化发展的现实，政府权力社会制约的有效实现应当是致力于 不断发展与完善市场经济体制，构建制度化的公民社会自治体系，建立参与——治理 型的行政模式，塑造具有独立地位的舆论监督媒体。 关键词：权力；政府权力；市民社会；社会制约 I 广东商学院硕士学位论文  论政府权力的社会制约——国家社会二元化下的宪政实践  Abstract Restriction Of Government Power By Society means that under the separation of state with civil society, disposing society rights resource through the principle of democracy and legal procedure, optimizing structure of social rights, organizing the strength from society to standard the operating procedure of governmental power, enhancing the benefit of governmental power, to realize the cooperation of nation and society. The logical beginning of society restriction of the governmental power is the separation of political country and the residential society. The polity origin is the peoples sovereignty theory. The theory prop is the society restricts the authority theory. The modern west constitutional countries mainly compose special interest group, the pressure groups and Inter-essenver bands to restrict the governmental right. According to competitiveness and cooperation they emphasize, it can be classified into the pluralism pattern and the corporatism pattern. The restriction in China receives hindrance of tradition of the politics, economic, and culture condition. It has also experienced four different stages in the contemporary development. To realize the restriction needs consummating the market economy system, constructing the citizen autonomous system, establishing the participating administrative pattern, molding dependent media.
