内容摘要 近年来，伴随着信用卡事业的发展，信用卡诈骗犯罪在世界范围内呈 现上升趋势。由于该罪是一种新型犯罪，加之犯罪手段呈现多样化，导致 理论界与司法实务中对该罪的认识存在许多分歧。为了更好地防范和惩治 信用卡犯罪行为，笔者特以此为题，着重对信用卡诈骗犯罪的基本情况、 法律对信用卡诈骗犯罪的规定以及司法实践中出现的一些具体问题进行探 讨，并提出了对该罪进行立法完善的建议。 全文共分为四章，约 23000 余字： 第一章 信用卡诈骗罪概述。本章主要阐述信用卡与信用卡诈骗罪的概 念、国内外关于信用卡诈骗犯罪的立法状况以及我国刑法中信用卡的范围 界定。 第二章 信用卡诈骗罪的犯罪构成研究。本章从信用卡诈骗罪的犯罪客 体与犯罪客观方面、犯罪主体与犯罪主观方面进行分析，并着重研究了“使 用伪造的信用卡”、“使用以虚假的身份证明骗领的信用卡”、“使用作废的 信用卡”、“冒用他人的信用卡”与“恶意透支”的法律特征以及单位能否 成为信用卡诈骗罪的主体和主观上是否要求“以非法占有为目的”等问题， 以深化对信用卡诈骗罪的整体认识。 第三章 信用卡诈骗罪的司法认定。本章主要对目前理论界争论较大的 盗窃信用卡并使用、伪造信用卡并使用、拾得信用卡并使用、盗划信用卡 等相关问题进行了深入分析探讨。通过分析，作者认为伪造信用卡并使用 应根据具体情况考虑认定为牵连犯；盗窃信用卡并使用、盗划信用卡、拾 得信用卡并使用均为信用卡诈骗罪。同时，笔者认为，信用卡诈骗罪与一 般信用卡纠纷的关键区别在于其主观要件与数额要求。 第四章 信用卡诈骗罪的立法缺陷和完善。本章主要讨论了我国信用卡 诈骗的立法缺陷，并初步提出了一些完善的建议。 关键词：信用卡诈骗 犯罪构成 司法认定 立法缺陷 Abstract With the development of credit card undertaking in recent years,the crime of credit card cheating shows an upward tendency all over the world.Because this crime is a new kind of guilty,besides the means of the crime vary widely,so there exist many divergences on the comprehension of the crime both among theorists and in judicial practice.For preventing and punishing the deeds of credit card cheating,the author discussed on this topic,especially discussed the basic situations of the crime of credit card cheating,the regulations about the crime of credit card cheating of law and some detailed problems occurred in the practice,and proposed some suggestions on legislative perfection of the crime.
