2009 年度山东省环境保护优秀论文集 环境污染无过错免责与一般民事责任免责的主要区别 李艳华 （山东省环境保护学校，济南 250014 ） 摘 要：民事责任免责可分为一般民事责任免责和特殊民事责任免责。环境污染无过错民事责任免责属于 特殊民事责任免责。一般民事责任免责和环境污染特殊民事责任免责，虽然有许多相同之处，但两者在免 责的范围、条件和情节等方面却有着很大差别。本文从“关于不可抗力导致的免责”和“关于受害人过错所导 致的免责”等两个方面，论述了两者之间的主要区别。随着环境污染民事责任的适用原则、要件构成理论研 究的基本明晰，研究的重点也会由适用原则、要件构成理论转向具体环保法律规范的适用上来。因此，本 文对环境污染民事责任免责的研究，既是环境污染民事责任研究重点转向的结果，也为处理相关案件提供 理论支持。 关键词：无过错免责；一般民事责任的免责；主要区别 The main difference about Environmental pollution no-fault exemption and exemption of general civil liability Li Yanhua (Shandong school of environmental protection, Jinan 250014) Abstract: Civil liability exemption can be divided into general civil liability exemption and special civil liability exemption. No-fault civil liability exemption for environmental pollution belongs to special civil liability exemption. There are many differences between the exemption of general civil liability and special civil liability for environmental pollution in the scope , conditions and circumstances of the exemption and so on. In my paper, I discussed the main differences between them in the exemption force majeure caused by and the exemption the fault of the victim caused by. With further clarify of theoretical study on the applicable principles of civil liability for environmental pollution and the necessary conditions, the focus of the study will turn the applicable principles and the necessary conditions to the application of specific laws and regulations on environmental pollution. Therefore, my discussion on the exemption of civil liability for environmental pollution is in compliance with the overall trend of the research on the civil liability for environme
