VValueValuealue EngineeringEngineeringEngineering ·225 · 民主视角下行政立法公开征集意见析论 Analysis of Executive Legislation Soliciting Opinion in Public under the View of Democratic 李洋 Li Yang （云南大学公共管理学院，昆明650031） （Yunnan University School of Public Administration ，Kunming 650031，China） 摘要： 我国的行政法规和规章因其调整的社会范围之广，几乎遍及公民生活的各个方面。为使这些行政法规和规章更好地保护公民利益， 防范立法权被滥用，在行政立法程序中引入相应的民主参与机制即公开征集立法意见是十分重要且必要的。本文先从行政立法公开征集意 见的意义与价值出发，指出公开征集立法意见能捍卫公民表达自由的宪法权利，保障所立之法符合民主的核心要义。然后再从经济地位不平等、 信息不对称等事实入手，分析这种表面民主下存在的问题。最后针对如何完善行政立法中公开征集意见制度提出自己的见解与设想。 Abstract: Adjustment of Chinas administrative rules and regulations has a wide society scope, almost throughout all aspects of civic life. To make these administrative rules and regulations better protect the interests of the citizens and to prevent abuse of legislative power, introducing the democratic appropriate mechanisms: soliciting legislative advice in public is very important and necessary. This article from the meaning and values of executive Legislation soliciting advice in public points out that soliciting legislative advice in public can defend the constitutional rights of citizens freedom expression and protect the legislation of the law is consistent with the core essence of democracy. And then starting from the economic inequality, information asymmetry and other facts, the paper analyzes the problems under the surface democracy.
