W ith balanced benefits as the base point, the defin ition of the protection scope of the patent right for an invention or utility model shall follow the tradeoff principle that based on the clami of right, includes both the same features and equ ivalent features. M eanwh ile, in accordance w ith the principle of honesty and fairness, the doctrine of prosecution h istory estoppels and plea known tech nology shall be taken as the exclusion principle.
