Abstract The land collectivization system ofChina,which is originated in planned economy，betaken from 1 949 tO now and has neverbeen touched the ground，is incompatible with the process ofthe reform of market economy system Them many abuses in the qualification ofthe purpose，the zoning，and the redemption ofthe land collectivization which have conduced the suspended or waste use ofthe land anddecreasetheefficiencyoflanddistribution．Asaresult,the social stabilityisaffectedbYtheincrease offarmerswholosttheirland．Meanwhile，withtheadvancementofthemarketeconomy reformandthe entranceofWTO(WorldTradeOrganization)，reinforcementofproperty rightincludinglandproperty right has become a hot topic which brings more and more people’S concerti．Hence，it is urgent tO reformtheChineselandcollectivizationsystemwhichinvolvestheclarificationofthepurpose，rational landplanningandimprovementofreimbursement． Thisthesisisasystematicandin-depthresearchintotheproblemsarisingfromthe landcollectivization． Aimingatthemajordefectionsofthecurrentsystem，itanalyzestheproblemsbyapplyingtheoriesof propertyrighLlandtax，publiceconomics，publicadministrationandother relatedtheories．Basedon the domestic reality and the experiences home and aboard，it put forward a detailed proposal for improvement ofthe land collectivization system from following perspectives：the standards for land collectivization，the subject and procedure ofauthentication，and the reimbursemem to the peasants． The scheme is composed by several parts：to restrict the bound of‘‘public interests”by means of enumeration mad generalization；to consummate the procedure ofthe identification ofland use by pro— rooting the concept ofproper procedure and the sprit offalmess，openness，and efficiency；tO resolve theexistedproblemsbyestablishingamarket-priceoriented standardanddiversifiedmethodsofland reimbursement． ．2． 1 绪论 l l问题的提出及研究的意义 {：地征用是指国家为了公共目的而强制取得其他民事主体的土地并给以补偿的一种 行为。我国实行的是土地的社会主义公有制，土地所有权主体为国家和集体，其他任 何单位或个人对土地只享有土地使用权，而不能拥有土地所有权，这是我国土地制度 与其他资本主义
