和法律调控机制。 其次，文章对当前我国的农民集体所有土地征用制度中存在的问 题进行了归纳分析和讨论，总结出了我国农民集体所有土地征用制度 存在的主要问题是：第一，相关法律中未对征地权行使的公益目的范 围进行严格界定。第二，现行征地立法中，对土地所有权及其之上的 他项权利附随征用问题，缺乏共同性规定以及具体法律规定。第三， 征地补偿方面规定不完善，征地补偿问题突出，征地补偿安置费用被 征地农村集体经济组织和农民之间分配不尽合理，使用管理混乱。第 四，征地拆迁与安置问题规定较少。第五，对征用土地行为中的有关 监督和救济、责任、程序等方面规定不完善。 在本文最后一部分，笔者针对当前我国农民集体所有土地征用中 存在的具体问题，提出了～些对策和立法建议，主要包括：改革和完 善当前我国征用土地法律制度的取向选择和目标以及原则，要明确当 前征用土地法律制度改革和完善的重点是建立征地的利益平衡调控 机制；确定土地征用权设立的法律依据；严格限定公益性用地范围， 规定征地权只能为公共利益的需要而行使。完善土地征用补偿法律制 度；建立和完善有关征地安置保障制度；完善征地程序控制，健全相 关征地救济立法。 关键词：农民集体所有土地征用法律制度问题对策 Abstract Starting with the history background ofthe land exproprimion system practiced in our country, and following the development path of the system up to the present situation ofthe expropriation of the land owned collectively by farmers，this article analyzes the content of land expropriation 1aw system in difierent periods，and summarizes its features during vatious historical stages，including the curTent situation．The author believes that our present collectively-owned land expropriation system descends historically from the land expropriation system constituted right after the foundation of our country,and only by taking this idea as a starting point to analysis and investigation，can we put forward scientific and practical advices to our future land expropriation refom and legislation． Atier making fl Comprehensive survey ofme development and the current situation ofthe 1and expropriation system，we carl find it self-evident that our land expropriation principle,thou曲 existing for a long time，is only a revised and supplemented version ofthe outdated rules，so it has to accommodate to the original system，especially in the legislation form．And also，the original land expropriation system wss constituted in the planning economy,but the revised land expropriation principle still can‘t make any breakthrough．First，our land expropriation，not complying with jntemational convention．hash’t been formulated as a restriction system ofthe basic civil rights in the
