论保险合同解除权与撤销权的适用关系季昱辰摘 要：如实告知义务是保险法中一项重要的制度，然而当投保人违反保险合同告知义务时，根据《保险法》和《合同法》的规定，将产生保险人法定解除权与合同撤销权的竞合。2013年6月8日施行的《关于适用中华人民共和国保险法若干问题的解释(二)》中并没有对此问题做出解释与规定，因此，有必要对此问题进行更为深刻的研究，以解决我国现行法律存在的分歧与矛盾。本文共分为四部分，第一部分介绍了投保人违反告知义务时产生的两种不同的法律后果，并对二者做出了对比，从而揭露了二者的主要差别所在；第二部分论述了目前学术界对此问题存在的三种学说，即排除说、选择说与补充说；第三部分针对三种学说做出具体分析，并提出自己的观点，认为保险法中保险人基于违反告知义务产生的法定解除权其实为合同撤销权的异化；第四部分为结语，并对保险法之完善提出了相关的建议。关键词：保险合同；解除权；撤销权；竞合Abstract：The duty of disclosure is an important system of insurance law, however, according to the Insurance Law and Contract Law, when the insurant breaches the duty, the insurer respectively has the right to terminate the insurance contract, then concurrence exists. In the Interpretations of The Supreme Peoples Court on Certain Issues concerning the Application of The Insurance Law of The Peoples Republic of China(Part Two) which is effective on June 8, 2013, there is no interpretation about this problem. Therefore, it is necessary for a deeper study of this problem, to resolve differences and contradictions existing in the current law of our country.
