毕 业 论 文 题 目： 论三权分立与法治 学 院： 法学与公共管理学院 专 业： 法学 姓 名： 高丽佳 学 号： 151409203 指导老师： 李国华 完成时间： 2013年05月24日 内容摘要 三权分立是为了解决权力之间如何相互制衡而建立的一项法律制度。该制度不仅对国家治理模式的确立有着至关重要的作用，而且能够有效制约权力，保障公民权利，为法治的实现提供有效的制度保障。因此，很多国家在其宪法中对权力制衡做出了明确的规定，成为法治实现的必由之路。我国也将法治作为国家治理和法治建设的目标，并将“依法治国，建设社会主义法治国家”明确载入我国宪法，为法治的实现提供了法律基础。本文对三权分立理论的历史起源、发展历程、理论和实践意义、法治的含义、现代法治的主要内容、中西方法治理念的差异等进行了论述，并探讨了我国在议行合一的人民代表大会制度的基础上如何有效的利用三权分立的优点进行权力制衡。 关键词：三权分立，权力制衡，法治 Abstract Separation of powers is to solve how to checks and balances between power and set up a legal system.
