保险诈骗罪第四款解释路径之选择

摘 要:保险诈骗罪第四款的规定不是片面共犯的立法体现，因而片面共犯理论无法对其性质做出合理解释。
同样，想象竟合和法规竞合理论，法律拟制和注意规定理论由于自身的不周延亦难以给出合理的解释。因此，
在选择保险诈骗罪第四款的解释路径时，需要立足于法律文本，依据大竞合理论进行解释。

The Choice of Interpretative Route about the Fourth Paragraph of the Crime of Insurance Fraud

Abstract: The fourth paragraph of the crime of insuranωfraud is not the legislative embodiment of unilateral com-
plicity , therefore , the theory of unilateral complicity cant give a reasonable interpretation to the nature of 也e four也
paragraph. And , because of their own defects , the the呵。f imaginative joiner and coincidence of articles , legal fic-
tion and provision of attention also cant give a reasonable interpretation. Therefore , when we ch∞se the interpretative
route about the fourth paragraph of 由e crime of insurance fraud , basing on the legal text , we can mak.e the reasonable
interpretation by the theory of large coincidence.
