硕 士 学 位 论 文 中国食品安全惩罚性赔偿适用问题研究 The research on the application of punitive damages in the field of Chinas food safety 作 者 姓 名： 刘健 指 导 教 师： 胡大武 西 南 政 法 大 学 Southwest University of Political Science and Law 1 内容摘要 《中华人民共和国食品安全法》第96 条规定了惩罚性赔偿制度，但 96 条只是一个原则性的规定，对如何确定惩罚性赔偿金和惩罚性赔偿适用的 构成要件等没有做出明确的规定，惩罚性赔偿的规则也不够严谨，且过于 简单，所以还是纸面上的法律，至今也没有比较典型的相关判例。 本文第一部分提出了我国食品安全领域惩罚性赔偿制度在适用中存在 的问题：首先表现在重视刑事和行政的打击力度，但是忽视对消费者的赔 偿。其次是具体在何种情况下能够提起惩罚性赔偿的诉求没有明确的规定， 即惩罚性赔偿的构成要件有待完善。再次就是没有成立对问题食品的检测 与鉴定机构，导致食品安全维权难度较大。解决问题的前提是找到问题的 原因，第二部分笔者从三个方面分析了存在上述问题的原因。我国的惩罚 性赔偿制度跟欧美很多国家相比起步比较晚，适当的借鉴国外的立法经验 对我国惩罚性赔偿制度的完善是很有帮助的。故在本文第三部分，笔者介 绍了国外惩罚性赔偿制度的相关规定，主要是关于惩罚性赔偿制度的构成 要件的规定和惩罚性赔偿金的相关规定。这两个方面的规定是适用惩罚性 赔偿制度根本性的和必须要解决的问题。最后一部分，针对我国现阶段食 品安全领域适用惩罚性赔偿中存在的问题，笔者提出了解决问题的对策和 完善我国食品安全惩罚性赔偿制度的建议。包括重视对消费者的赔偿和加 大赔偿力度，完善惩罚性赔偿制度的构成要件和建立统一的食品鉴定机构。 关键词：惩罚性赔偿；食品安全；惩罚性赔偿金； 构成要件 2 Abstract Article 96 of The Food Safety Law of the Peoples Republic of China provided for punitive compensation system, but there are no provisions on how to determine the compensation amount of punitive damages and the constitutive requirements of punitive damages,only because its just a principle provisions.The rules of punitive damages is too simple and not precise enough, so it is still the law in paper, there is no relevant typical cases. In order to make the provisions of the punitive damages in Food Safety Law play a role in the governance of food safety issues, the resolution of these issues is essential.
