Under the influence of judicial activism, retentive service needs to be greatly promoted which is one of measures to guarantee proceeding. Article 79 of Civil Procedure Law, article 82 of the supreme court of number of issues concerning the application of the views of Civil Procedure Law and article 11of the application of the regulation of summary proceeding have relative provisions on retentive service . However, in practice, using retentive service is limited by users’ activism, passive justice and judicial authority. Therefore, we must built guarantee proceeding of judicial activism in order to make retentive service play an important role in promoting civil dispute resolution and achieve the unity of fairness and efficiency. It is from two aspects of users and procedure.
