AbstractWiththefastdevelopmentofrealestateindustry,advancesaleofcommercialhousinghasturnedintothemainwayofcommercialhousingsale.Itnotonlyplaysanimportantroleinwidelyfinancing,revitalizationofmanagementandriskavoidanceforlandagents,butalsospurstherealestatemarketandimprovesinhabitants’housingconditions.However,thereemergedalotofnegativeproblemsrecentyears.Infact,theobjectofcontractofadvancesaleofcommercialhousingisakindof“rightofexpectation”,whichonlycanberealizedafterthecompletionofcommercialhousingbuilding.Therefore,unrealityofcommercialhousingandinequalityofthestatusbetweenpre-sellerandpre-buyerindicateallkindsofrisksfacingpre-buyers,whichisdeterioratedbycheatbehaviorsofpre-sellers.Throughthelegalanalysesoftherisksofcheatfacingpre-buyersofcommercialhousing,thispaperpresentstheformsandconstitutesofcheatbehaviorintheadvancesaleofcommercialhousingmarketforthepurposeofprotectingthelegalrightsandinterestsofpre-buyersthoroughlyandboostingthedevelopmentofrealestateindustryinahealthyway.Asfortheconstructionofthispaper,apartfromtheintroductionandconclusion,itisdividedintofourparts:Thefirstpartisconcernedwithabriefintroductionofadvancesaleofcommercialhousing.Inthefirstplace,itdealswiththeorigin,definitionandformsofadvancesaleofcommercialhousing.Itaffirmsthegoodaspectwhilerevealstheriskspresentinitself.Then,itanalyzesthenatureofthecontractofadvancesale,andmaintainsitasforwarddeliverycontract.Italsodiscussesthebasicrightsofpre-buyers,whichisaforeshadowofthediscussionoftheprotectionofpre-buyersafterwards.Atlast,itexplainsthedefinition,characteristicsandlegalconstitutesofthecheatbehaviorinadvancesalemarketinordertodrawanoutlineofcheatbehaviorsforpre-buyers.Inthesecondpart,throughtheanalysesofthecheatrisksfacingpre-buyersofcommercialhousingcombinedwiththedetailedcases,itsummarizesthelegalconsequencesduetothecheatbehaviorsofpre-sellersinordertoputforwardaclearideaofcheatbehaviorsforpre-buyers.Inthethirdpart,itdealswiththeprotectingsystemforthepre-buyer’srightsandinterestsinexiste
