内容摘要未成年人作为特殊的侵权主体，其侵权责任要比一般的侵权责任复杂得多。 这是由于未成年人欠缺相应的辨别能力、控制能力以及赔偿能力，在其侵权致害 后不能有效的承担和履行责任。为了使此问题得以解决，引入监护人责任以及公 平责任实之必要。全文以此为出发点，对未成年人侵权的自己责任、监护人责任 以及公平责任分别予以论述，以期能对我国未成年人侵权责任问题研究有所裨益。本文除引言和结语外，共分为四个部分。 第一部分是案例的简介以及案例所引发的思考。本部分通过三个未成年人侵权的案例，引出未成年人容易侵权致害的原因以及其侵权责任的特殊性和复杂性， 进而对我国现有的有关未成年人侵权责任的法律规定的科学性、合理性提出疑问。第二部分主要论述未成年人侵权的自己责任。首先提出并且分析了未成年人 是否需要承担自己责任的问题，并以此问题为基点，进而论述民事责任能力制度 以及未成年人侵权中过错的认定，最后得出未成年人在其有责任能力且有过错的 情况下需要承担自己责任的结论，并因此提出相应的立法建议。第三部分主要论述未成年人侵权中的监护人责任。首先分析了引入监护人责 任的原因，进而对两大法系中监护人责任的归责原则以及监护人责任类型进行了 比较法考察，最后提出我国应该采用的归责原则和责任类型以及立法建议。第四部分主要论述未成年人侵权中的公平责任。首先对引入公平责任的原因 进行了分析，进而分析了我国的立法现状，最后论述公平责任在未成年人侵权中 的具体适用情况并提出相应的立法建议。关键词：未成年人侵权；民事责任能力；监护人责任；公平责任AbstractMinors as a special subject of the infringement, the infringement responsibility is much more complicated than the general tort liability.This is due to a minor lack of the corresponding discrimination ability, control ability and the appropriate compensation ability. In order to make this problem solved, the introduction of the guardian responsibility and fair responsibility is really necessary. The thesis regards this as the starting point, for minor self responsibility, guardian responsibility and fair responsibility respectively discussed, in order to benefit the study of Chinas juvenile tort liability.The article, besides foreword and conclusion, is divided into four parts.The first part is the case introduction and the thinking about the case. This part leads to minors easily tort reasons and the tort liability of the particularity and complexity through three a minor infringement case, and then ask questions on Chinas existing relevant minors tort liability law whether is scientific and reasonable or not.The second part mainly discusses the juvenile tort own responsibility.
