摘要摘要公众参与环境信息公开问责旨在预防和惩戒环境信息公开部门的信息公开违法行 为，公众可以通过参与环境信息公开主体公开工作评价，依法履行独立的环境信息监督 职能和提起行政诉讼的方式“问责”政府。公众参与信息环境公开问责的多元价值体现， 有待于从从经济学，法理学和环境法学的不同维度考察。近年来，尽管我国的信息公开 工作取得了一定成绩，然而，一旦公众申请涉及自身“最为关心”的本应主动公开的信 息，则困难重重。此外，根据实践调查，信息问责制度公开方面，尚缺少明确的责任部 门及责任人的义务内容。由于环境问题和环境信息的社会性、现实性和普遍性倾向明显， 因此，公众参与外部问责极具紧迫性。公众参与问责首先要了解公众参与意愿。根据笔 者环境信息公开评价及公众参与问责主观态度考察，就各方面的情况来看，我国当前的 政府环境信息公开内容亟待拓展。公众参与环境信息公开问责的不同纬度，主观意愿不 同。政府不仅要提升自身的的公信力，还需要从提升公众信任角度提升司法的公信力。 其次，公众参与问责的建构要建立在充分反思现行制度和了解国外经验的基础上。实事 求是的考察，我国当前的政府环境信息公开已经实现了“内部”多元问责，然而，本质 上存在诸多缺陷。因此，顺应民主趋势，优化制度环境，逐步引入并强化外部制约是大 势所趋。这种外部机制是由公众参与考评制度、环境信息领域的独立监察专员制度和公 民或环保组织提起的环境信息公开行政诉讼构成。三者各自发挥比较优势，共同作用于 政府环境信息公开工作的监督和治理。其中，参与考评直接影响了政府及其工作人员的 行为方式的合法性与合理性，监察专员赋予人民实实在在的监督权力，潜在的广泛参与 监督主体的行政诉讼活动，将推动司法效应发挥作用。外部机制的建构不能一蹴而就， 迫于传统体制机制的压力，当前比较务实的是内外的结合，逐渐过渡，外部问责占主导 则是大势所趋。关键词公众参与；环境信息；公开；问责；制度AbstractAbstractPublic participation in environmental information and public accountability aims to prevent public sector disciplinary environmental information disclosure violations.
