AbstractThecrossedcaseofthecivillawandcriminallawisalong-standingdifficultproblemfortheoristsandpractitioners,thisarticlefromtheperspectiveofprotectingtherightsofthepartiestoanalyzethelackofprotectionofprivaterightsinthecurrentlegislativeandjudicialpractice,whichisanotherperspectiveofre-interpretationofsuchcomplexcasestoperfecttrialsystemofcriminalcasecrossingwithcivilcase.Firstly,thisarticleintroducingthetheoryofcriminalcasecrossingwithcivilcase.Thecrossedcaseofthecivillawandcriminallawisacasewhichcriminallitigationcrossingwithcivillitigationbecausetheexistenceofthesamelegaltruth.Thestandardofcriminalcasecrossingwithcivilcaseisthesamelegalrelationshipisinvolved.Therearethreewaysindealwithcriminalcasecrossingwithcivilcaseintrialpractice:“criminalfirst,civilsecond”“civilfirst,criminalsecond”and“criminalparallelwithcivillaw”,allofthemhavethereasonableofexistenceanddifferentscope.Secondly,thisarticleanalysistheoperationofcriminalcasecrossingwithcivilcasefromwhichaffecttherightsofthepartiesfromboththelegislativeandjudicial.Inthelegislation,becauseoftheimpactoftraditionalvalues“emphasisoncriminalandignorecivil”andtheprotectionofprivaterightsareoftenignored.Inthejudicialpractice,bothproceduralandsubstantiveshortcomingsareeasilyinfringedontherightsoftheparties.Proceduralshortcomingsare:choosethewrongtreatmentfromthethreemethods,convergenceofimproperprocedure(jurisdiction,reviewandtransferproceduresofcriminallitigationandcivillitigation),theconflictofimplementation(theconflictbetweencoercivemeasuresofcriminallitigationandpropertypreservationmeasuresofcivillitigation,theconflictbetweencriminallitigationandcivilenforcementproceedings),affectingtheimplementationoftheproceduralrightsoftheparties.Entitydrawbacksare:theconflictbetweencriminaljudgmentsandciviljudgments,theconflictbetweenthecriminalbootyandcivilcompensation,whichwillultimatelyaffecttherealizationofthepurposeofthepartyaction.Finally,whethertheneedofreliefofrightsorthelawconceptofprotectrights,thereneedtoreconstructt
