摘要埃利希是欧陆法社会学的奠基人，他的法社会学理论具有开创性意义。埃利 希法社会学的研究成果卓著，其理论观点集中体现在其论著《法律社会学基本原 理》一书中。在此书中，埃利希提出和阐述了“活法”论、法律发展的社会重心论、 法律的自由发现论及法社会学的研究方法。本文即以《法律社会学基本原理》为 核心，力图较全面的阐述其上述法社会学思想。全文主要由绪论，第二至第四章及结语组成。 绪论：概述埃利希法社会学理论体系和国内外对埃利希法社会学理论的研究现状。概括介绍当下中外学者对埃利希法社会学思想研究的主要关注点及研究中 的困境和不足，点出本文的研究思路和方法。第二章：埃利希法社会学理论产生的背景。本章分为埃利希的学识结构、社 会历史背景、思想理论来源三个小节，着重追述埃利希出身的犹太律师家庭、多 年的求学和教学经历，结合其关注社会问题、注重实证研究的学术倾向，寻求法 社会学理论的学识基础。分析19世纪末、20世纪初欧美资本主义社会的政治、经 济及社会变革，发掘埃利希法社会学思想的社会基础。阐述埃利希对自然法、分 析法学、德国历史法学及社会学的批判分析，以求证埃利希法社会学理论的思想 理论渊源。第三章：埃利希法社会学理论主要观点。为使埃利希法社会学理论全面系统 的呈现出来，本章试图详细梳理埃利希法社会学主要理论，即“活法”论、法律发展 的社会重心论、法律的自由发现论三大理论，并对其上述理论的基调、方法进行 论证分析。第四章：埃利希法社会学理论的研究方法。一是讲求对法律史与实用法学的 考察与解读，二是注重对“活法”的关注与研究。通过阐述其研究方法，进一步揭示 其法社会学理论的内涵。结 语：文章认为，“活法”论、法律发展的社会重心论、、法律自由发现论及法 社会学的研究方法集中体现了埃利希的法社会学思想。同时，他把法学研究仅限 定在社会联合体的范围内，缺乏对法律现象的纵向分析，这也注定了其理论的局 限性。但其仍不失为一部系统、完美之理论，它提示着世人要注意社会本身的秩 序和“活法”对国家法治发展的重要意义。关键词：埃利希，法社会学，社会联合体，“活法”ABSTRACTEhrlich is recognized as the founder of European sociology of law . his theory of sociology of law was provided with ground-breaking significance.Great achievement has received about his research of sociology of law.the view of his great thought embodied in his work named as Fundamental Principles of the Sociology of Law .In this work, Ehrlich proposed and explained his living law, the center of gravity of legal development lies in society itself,freedom to seek and create law. and research methods of sociology of law .So the text based on hisFundamental Principles of the Sociology of Law ,in order to elaborate more comprehensive thought of sociology of law.This dissertation consists of an introduction，three chapters and a conclusionIn the introduction Part : It brings out Ehrlichs theoretical system of the Sociology of Law and the current research situation about China and other countries on the sociological theory of Ehrlich .Overviewes Chinese and foreign scholars contemporary researches on the sociology of law in term of the major concerns and the difficulties and deficiencies .and points o
