It is one of the international crimes which the whole world has paid great attention. The Crimes against humanity can be found in the Treaty of Sèvres of the twentieth Century in the beginning. The Charter of the International Military Tribunal clearly stipulates the Crimes against humanity, and put it into practice. Crimes against humanity develops with the continuous development of international criminal law. And the international community has paid more and more attention to it.The paper is conducted by kinds of research methods including literature analysis, normative analysis, case analysis as well as comparison analysis. Through reviewing the development history of Crimes against humanity, the paper divides the history of crimes against humanity into two phases with the clue of legislation period. The paper has conducted a research on two phases especially on the changes in different phases, focusing on the innovative parts of crimes against humanity in the present stage of development. The paper has discussed from entity creation and procedures creation and has concluded that the Rome Statute of the International Criminal Court is a monument in the history of crimes against humanity. The Libya situation is the latest judicial practice of crimes against humanity and enriches the content of crimes against humanity. Through the in-depth analysis of the Libya situation, the paper has summarized four aspects of the judicial creation of the Crimes against humanity. There is no doubt that crimes against humanity has new development now. Thus, in theory, the characteristics of practical rules of Crimes against humanity and its trend can be defined clearly.
