中文摘要各国的发展经验都表明,和谐稳定的劳动关系是一个国家经济持续健康发展的重要 前提条件,持续不断、日益激烈的劳资冲突必然会阻碍企业生产经营秩序和经济增长, 影响社会稳定,甚至危及国家安全。集体谈判权是伴随着集体劳动关系的发展而由法律 所确立的劳动者的基本权利。集体谈判权作为集体劳权通常是由劳动者集体享有,并由 工会作为劳动者的代表来行使的权利。通过规定不当劳动行为制度和诚信谈判的责任来 加强工会作为集体谈判权组织保障的作用。集体谈判权是通过集体谈判制度来实现和保 障的。要实现集体谈判权,必须对谈判的内容和过程予以规范。当前,我国正处在体制改革、结构调整与社会历史性变革的转型时期。市场化的劳 动关系已基本形成并逐步占据了主导地位。但在实践中,适应市场化劳动关系的调节机 制和制度还很不完善。建立有效的劳动关系调整机制是完善市场经济体制的必然要求。 集体谈判和集体合同制度是市场经济国家用以调整劳动关系而普遍实行的一种劳动法 律制度。通过集体谈判和集体合同制度的推行,可以及时充分地反映职工的意见、要求, 把自发的、无序的冲突,变为有序的依法协商和协调,保证劳动关系的和谐稳定运行, 促进企业健康发展。集体合同制度使得劳动者与用人单位在实际地位上获得一定程度的 平等,从而有效地维护劳动者的合法权益。本文尝试在结合理论与实践的基础上,探讨 集体谈判权的定义、性质、内容、效力等方面,分析我国集体合同制度的不足,并提出 完善建议。结合文献研究、比较分析等方法进行深入分析,指出我国集体合同制度的不 足之处,进而提出完善我国集体合同制度的建设性意见。关键词:集体谈判权集体谈判制度集体合同AbstractAccording to the experiences of western industrialized countries, a congruent,stable labor relationship serves as a prerequisite for the sustained and healthy development of a national economy. In contrast, a perennially discordant, tumultuous labor relationship will bring about disorder to corporate management, disrupt economic growth, exert a destabilizing effect on social order, and possibly endanger the national security. Right of collective bargaining is admitted by law as one of the basic labor rights with the developing of collective labor relations. As one of the collective labor rights, right of collective bargaining is owned collectively by labor and used by the labor union which is the representative of the labor. By the regulation of unfair labor practice and the responsibility of honest bargain, the labor union can be stronger to bargain with the employer. Right of collective bargaining is realized and protected by the collective bargain system of law. To realize right of collective bargaining, the content and procedure of bargaining must be regulated by law.At present, our country is during the period of making the transition, going with system reformation, economy structure adjustment and social historical innovation.The market-based labor relation has already
