宁波大学硕士学位论文 宁波大学硕士学位论文 我国港口行政执法中存在的问题与对策研究 我国港口行政执法中存在的问题与对策研究 万方数据 万方数据 万方数据 万方数据 我国港口行政执法中存在的问题与对策研究 摘 要 本文以宁波-舟山港行政执法实践为依托，结合国内外典型案例，对我国港口行政 执法中所遇到普遍性问题进行分析，找出这些问题背后的原因，最后以法律人的视角、 佐以专业知识提出相应问题的解决方法。 论文结构分为四大部分，主要内容有：第一部分、介绍了港口行政执法的概念、特 点、内容、技术标准以及相关法规体系；第二部分、以典型案例为注解，引出港口行政 执法中存在的执法依据不足、港口管理模式迥异、市场环境庞杂、行政执法乱象频现以 及港口管理职能缺位重叠等共性问题；第三部分、先对港口行政执法问题进行深度的原 因分析，再适度地拓展,然后从法律制度不完善、法律适用上的误区、港口体制改革欠 彻底、行政执法手段欠缺、行政执法理念不清、执法队伍素质不相配等角度进行阐释； 第四部分、基于问题成因分析，从完善法律制度、创新行政执法模式、规范行政执法行 为、推动港口执法科技化以及执法标准化建设等方面畅谈提高港口行政执法水平的具体 思路与对策。 为了更好地表达写作意图，全文共引用八个典型性案例就我国港口岸线开发、工程 建设、经营管理、安全管理、信息化建设等内容进行注解，最后通过对体制改革、法律 制度、法律适用、执法理念、执法手段、执法队伍等问题成因的梳理与研究，得出了以 下的基本结论： 1.港口体制改革是港口行政执法的基础，它决定着港口行政执法的深度和力度。 2.完善港口法律制度，尤其是推进地方性技术型立法才是当务之急。 3.港口业是科技密集型的行业，加快港口行政执法信息化建设是势在必行。 4.重视行业标准的适用，推动企业安全标准化建设是功在当今、利在千秋。 5.打造高素质的港口执法队伍是任重道远，需要不断地努力才能实现。 6.港口行政执法水平提高不是孤立地推动，是系统性、多方位地推进。 关键词：港口行政执法， 存在问题， 对策研究 I Problems in Administrative Law Enforcement at China’s Ports and their Countermeasures Abstract This essay, based on administrative law enforcement practices at Ningbo - Zhoushan Port, combining typical cases at home and abroad, analyses the common problems encountered in administrative law enforcement at China’s ports, to find out reasons for these problems, and finally puts forward solutions to these problems at the visual angle of a legal person, combining with his specialized knowledge. This essay can be divided into four parts according to the structure.
