But the existing rules of law about wreck are numbered. So, from angle of academic study, in order to the sea stealing fish case as a learning object, use the case leads to wreck ownership of three problems: wreck ownership,ownership protection of the wreck and the elimination of the wreck ownership. On these three issues,author make an in-depth analysis.The first,clear the concept of wreck,wreck ownership,and the difference between ship and ship ownership;the second, from the perspective of the state and the individual,discusses the attribution of ownership of wreck;the third,take ship ownership registration system for comparison,search for a system of protection of the ownership of the wreck--take the system of wreck ownership;the last,points out the inadequacies of the existing shipwrecks laws,in 1957,《People’s Republic of China salvage management approach》promulgated by the Ministry of communications, and some shortcomings have been summarized and analyzed by author
