首都经济贸易大学硕士学位论文《电子商业汇票票据行为研究》 首都经济贸易大学硕士学位论文 《电子商业汇票票据行为研究》 I I 提 要 随着电子科技的发展，中国人民银行开发出电子商业汇票系统，电子商业汇 票的使用，不仅提高了效率性和安全性，使传统票据的支付功能得以了充分发挥， 同时还使票据的融资功能大大加强，使商事主体获得短期小额融资更加便捷。但 是由于电子商业汇票的运营尚处于初始阶段，学术领域对电子商业汇票票据行为 的探讨尚不充分，所以人们对电子商业汇票的认识还有待全面提高，因而有必要 对电子商业汇票票据行为理论进行系统的研究，以达到丰富理论、促进实务之目 的。本文采用了将电子商业汇票与普通汇票对比研究的方法，同时应用归纳总结 的方法对电子商业汇票票据行为的特征进行了探索性的总结。通过对电子商业汇 票票据权利由创设、变更再到消灭这一票据流转过程的深入探讨，将电子商业汇 票票据行为的问题归纳为交易真实性的审查、非本人实施的背书、登记系统的合 法性、贴现支付等几个问题，这些问题集中起来都表现为对票据交易流通性的阻 碍，解决这些问题则可以使电子商业汇票票据行为运行顺畅，使电子商业汇票的 支付与融资功能能够更好的实现。因而，本文在提出了电子商业汇票票据行为存 在的这些问题后，立足于电子商业汇票的基本功能，从基本理念、法律制度、实 践操作三个不同层面提出了解决对策，力争使电子商业汇票票据行为理论得以详 实的论述。 主题词： 票据 汇票 电子商业汇票 票据行为 II II Summary With the development of electronic technology，the Peoples Bank of China has gradually developed the electronic commercial draft system.The use of electronic commercial bill of exchange not only improves the efficiency and safety，so that the traditional bill payment function can be fully exerted，also makes bill financing function greatly strengthened， and the main commercial microfinance more convenient access to short-term. But due to the fact that the electronic commercial bill of exchange operation is still in the initial stage，the academic field of electronic commercial draft bill on the behavior is not sufficient，so view on the electronic commercial bill of exchange knowledge still needs improving.Therefore it is necessary to carry the electronic commercial draft bill behavior into systematic research ， with the purpose of promoting practice. This paper uses the electronic commercial draft and draft the comparative research method，at the same time,the application of inductive method of electronic commercial draft bill behavior achieve constructive summary. Based on the electronic commercial draft bill rights by creating，change to eradicate this bill circulation thorough discussion，the electronic commercial draft bill behavior problems into the authenticity of transactions review，I implemented endorsement， registration system
