I I 对完善我国特许经营立法的思考 中文摘要 对完善我国特许经营立法的思考 中文摘要 特许经营被誉为 20 世纪最成功的商业模式，在各国经济增长中都扮 演着举足轻重的角色。特许经营在我国的发展无论从理论上还是实践上 均起步较晚，由于市场经济的不完善及相关法律的缺失，特许经营的发 展过程中出现了许多问题，尽管国家先后出台了一系列的规范性文件， 但从我国特许经营发展的现状及未来趋势看，特许经营的快速发展对我 国的相关立法提出了更高的要求。本文正是在这样的背景下展开的。 本文从特许经营的概念及法律特征入手，分析了特许经营快速发展 的原因及意义。通过对特许经营在我国发展现状的介绍及国内外特许经 营立法的分析，阐述我国在特许经营立法方面存在的不足及国外立法的 借鉴意义，最后对完善我国特许经营立法提出几点具体建议。 关键词：特许经营，法律调整，立法完善 作 者：周李君 指导教师：史浩明 II II Abstract Reflections on improving our franchise legislation Reflections on improving our franchise legislation Abstract Franchise is renowned as the most successful commercial mode and plays an important role in the economic growth of each country. Franchise started late in China both theoretically and practically. During its course of development, many problems emerged due to the imperfection of market economy and the lack of relevant laws. Although China has staged a series of normative documents, the rapid development of the franchise has put forward higher requirements of the relevant legislation from the perspective of its current status and future trends. The article is expanded in such context. The article begins with the concepts and legal characteristics of franchise, analyzing the causes and significance of the rapid development of the franchise. Through introducing the current status of the franchise in China and analyzing franchise legislation domestic and abroad, the article expounds the existing deficiencies of franchise legislation in China and the lessons learned from foreign legislation, finally, makes a few specific recommendations on improving China’s franchise legislation.
