中 国 政 法 大 学 本 科 生 毕 业 论 文 2 - 中国政法大学 本 科 生 毕 业 论 文 浅析我国贪污罪的立法及完善 学号： 专业：法学 姓名： 学院：刑事司法学院 年级：2008级 指导教师： 完成日期：2012年3月10日 论文成绩： 浅析我国贪污罪的立法及完善 【摘 要】 贪污贿赂犯罪是古今中外刑法的打击重点，惩罚和预防方法各有不同。目前，我国加强廉政建设，遏制贪污犯罪行为，必须对贪污犯罪的原因及其它若干问题有个深刻认识，在此基础上，我们才能有针对性地提出预防此类行为的对策，做好预防工作。本文通过概念释义和比较分析的方法，对理论和事务中一些争议的问题进行具体的分析，并对比和借鉴国内外有关贪污罪的立法范例。本文共分为三部分来分析我国的贪污罪及立法完善。第一部分，具体分析贪污罪的主体，主要从三类不同性质的主体来分析。第二部分，以贪污罪的对象为出发点，对理论和实践中特殊类型的贪污对象进行研究。第三部分，以《联合国反腐败公约》为蓝本，与我国《刑法》中对贪污罪的具体规定进行比较，并借鉴他国立法经验，完善我国法律。 【关键词】贪污罪 《联合国反腐败公约》 立法完善 Introduction of Legislation and Improvement of Corruption in China 【Summary】 Corruption has been punished for thousands of years at home and abroad.There are various ways of forecasting and prohibiting Corruption .Presently, our country is constructing the clear and efficient government eliminating behaviours of Corruption.,so a deep acknowledgement of causes and feathers of Corruption if necessary.On the basis of clear awareness,we can make right measures in dealing with Corruption.Approaches of definition and comparison is used in this article and specific analysis is mainly focused the disputes in complex problems in theory and practice.Comparison and keep foreign legislation as references is also important ways in study.The article can be divided into three parts. In the first part, the subject of Corruption is analysed from the perspective of three different ones. In the second part, the major content is the object of corruption especially in the special ones.
