2 2 1 1 管理方面，政出多门，效率不足；实践中，地理标志保护的法律意识不够， 从而导致地理标志被混淆被淡化等问题存在。 第四部分对应上述第三部分的缺陷和问题，提出完善我国地理标志立 法保护的建议。创新之处在于，先从法理角度出发，完善立法理念及价值 取向，然后从管理效能出发，提出以工商行政管理局为监管体系的缘由及 优势，重点在于构建地理标志专门法，并提出一些立法建议。 第五部分结语，梳理明晰了上述探讨，构建适合我国国情的立法理念、 立法体系和执法机构，以合理地保护地理标志权利人的利益，平衡地理标 志权利人与社会整体利益之间的关系。 关键词：地理标志 国际保护 TRIPS 协议 立法完善 Abstract The well-known geographical indications such as Jingdezhen Porcelain, Switzerland Watch and Scotland Whisky does not only indicate the source and quality of commodity and service, reflect certain consumers’ taste, but also represent infinite commercial interests and carries special culture of the region. In the wake of the economic globalization, the role of geographical indications in international economy has enhanced gradually. Both global and regional international economic organizations start to harmonize different protection mechanisms of geographical indications across all countries involved. In China, the protection of geographical indications began comparatively late. It lacks power and different laws are contradictive to each other. Therefore it is very urgent to explore the value and laws of geographical indications. The main part of this article includes five parts. Part 1 first analyzes the meaning of geographical indications and compares it with other similar concepts, especially with trade mark in the angle of jurisprudence. It construes the reason why the protection mode of geographical indications shall be similar but not the same to the protection of trade mark. This part also analyzes the right nature of geographical indications. As private right, geographical indications is different from trade mark. It is a kind of exclusively collective right and it has comparative term. At last, this part provides theoretic basis to fulfill the Chinese laws of geographical indications.
