行政复议听证制度的地方实践与思考 ［岁商要］听证制度已被地方行政复议机构逐渐地引入行政复议审理中并且取得了不 错的效果，增强了行政复议决定的公信力。有些中央各部门和地方政府根据此条例制定了 行政复议听证审理规则，内容各有不同，而且容易发生冲突。因此，国家急需制定法律规 范，建立起我国统一的行政复议听证制度。随着厦门市经济社会发展和依法行政实践的不 断深入，行政复议工作的要求越来越高，已有行政复议与现实需要之间已存在一定的不适 应性，很多地方有待改进和完善，所以为了更好地达到复议为民、排忧解难的行政复议目 标，联系实际进一步深入开展行政复议工作实践和研究就成为必然。 ［关键词字］行政复议听证；行政复议；地方实践 Practice and Reflection on the Hearing System of Administrative Reconsideration Abstract： The hearing system has been gradually introduced into the administrative reconsideration hearing by the local administrative reconsideration institution and has achieved good results，which has strengthened the credibility of the administrative reconsideration decision. Some central departments and local governments in accordance with this Ordinance to develop administrative reconsideration hearing rules，the content of different, but also prone to conflict. Therefore, the state is in urgent need of legal norms, establish a unified system of administrative reconsideration hearing. With the deepening of the economic and social development in Xiamen City and the practice of administration according to law，administrative reconsideration work have become increasingly demanding, between the existing administrative reconsideration and realistic demand already exists certain adaptability.
