信用卡消费者权益保护研究以《消费者权益保护法》为视角.doc
内容
近几年,随着我国经济水平不断提升,金融市场不断发展,信用卡行 业也呈现高速发展的态势。但另一面,现行的信用卡法律体系与《消费者 权益保护法》并不能实现充分保障信用卡消费者权益,在实践中致使信用 卡消费者权益屢受侵害。比较突出的如信息披露不充分所导致的信用卡消 费者知情权被侵害,信用卡消费者的隐私权、选择权、抗辩权遭到忽视, 信用卡被盗或遗失后的风险分担不均衡等。本文拟从信用卡消费者权益保 护的基础理论角度出发,通过对信用卡消费者、开卡银行双方权利义务之 失衡展开分析,结合有关消费者权益保护的国外法律制度与监管经验,对 如何进一步保护信用卡消费者权益进行借鉴,以期对我国信用卡领域的法 律保护体系完善以及控制交易风险方面提出建议。
本文共分为四个部分:
第一部分,通过信用卡消费者信息泄露案的判解提出信用卡消费者权 益保护中存在的一些问题。
第二部分,分析信用卡消费者与发卡银行之间法律关系,以及信用卡 消费者权利义务关系的失衡。
第三部分,分析我国信用卡立法现存问题,在参考发达国家相关制度 成功经验的基础上,从均衡原则、立法改革、司法救济三方面为信用卡消
费者权益保护的救济与均衡提出建议。

Abstract
Recently, along with our country economy level’s rising, financial market development, the credit card industry also developing trend. On the other side, current credit card legal system and the《consumer protection law》can’t achieve full protection of credit card consumer rights and interests, they are infringed frequently in practice. The more prominent as inadequate disclosure of information caused by the credit card consumer right is infringed, the credit card consumer privacy, the right to choose, right to defense is ignored, the risk of credit card is lost or stolen after the share is not balanced. In basic theory of consumer rights and interests protection from credit card, through to the credit
card, the card bank consumer imbalance obligations of both rights analysis, combined with the foreign legal system and supervision experience about the protection of consumer rights, how to further protect the credit card consumer rights and interests for reference, put forward suggestions to perfect the system of legal protection for Chinas credit card business and trading risk control.
