内 内容摘要 1 1 从上世纪 90 年代开始，国有金融机构便一统天下，并在监管上实行“一行三会” 的一元金融管理体制，地方政府不能干预金融市场，但基于维护地方金融稳定的需要， 地方政府往往需要协助中央金融监管部门开展工作。随着市场经济的发展和金融组织的 创新，地方上出现了诸如小额贷款公司、典当行、担保公司、民间资本管理公司等新型 的类金融组织与民间金融，这使地方政府介入金融管理成为可能和必要。2012 年 3 月 28 日国务院批准设立温州金融综合改革试验区，就明确将“完善地方金融管理体制，防 止出现监管真空，防范系统性风险和区域性风险”和“清晰界定地方金融管理的职责边 界，强化和落实地方政府处置金融风险和维护地方金融稳定的责任”列入温州“金改” 的十二条任务之中，温州市政府取得了完善地方金融管理职能的新机遇。“金改”推进 一年多来，温州层面对地方金融监管体制进行了大量的有益探索，有些做法甚至在全国 均是首创。同时，浙江省人大常委会也针对温州前一阶段地方金融监管的试验经验，开 展全国首部民间融资立法，温州市层面由金融办编制了《浙江省温州民间融资管理条例》 草案，并获浙江省政府常务会议讨论通过，浙江省人大常委会也正在抓紧立法审议。对 地方金融监管体系进行梳理、定位和完善，已成为温州“金改”的一个重要研究课题。 关键词：地方金融；监管；完善 Abs Abstract 1 1 From the 90s of the last century, state-owned financial institutions have played the dominant role, and implemented the unitary financial management system of “one bank and three councils” in the supervision, the local government shall not intervene in financial markets, but need to assist in the central financial supervision departments to carry out the work owing to the need to maintain financial stability.
