中文摘要海关是国家进出境管理部门。海关行政执法腐败及防治有其自身的特点和 中文摘要 海关是国家进出境管理部门。海关行政执法腐败及防治有其自身的特点和 规律。本论文采用文献研究与实证分析相结合的方法，主要从公共管理的视角， 对海关行政执法腐败及防治作了理性分析和实践探索。从研究腐败定义着手， 对行政执法腐败的内涵进行论述，对海关行政执法腐败的概念作了界定。对当 前海关行政执法腐败现象的新特点和主要表现形式作了分析，提出必须关注当 前海关行政执法腐败呈现的新特点。从当事人自利本性、制度缺失和公共管理 伦理匮乏的层面剖析了海关行政执法腐败的根源。文章从防治行政执法腐败和 治理海关行政执法腐败宏观与微观相结合的角度，提出了完善海关行政组织体 制、改善行政执法的程序和方法、规范行政执法自由裁量权、加强行政执法监 督、加大惩戒力度、提高行政执法人员素质等预防和治理海关行政执法腐败的 基本对策，有效防范新形势下海关行政执法腐败现象的发生。 关键词： 海关 行政执法 执法腐败 对策研究 AbstractThe Abstract The Customs is the state organ responsible for supervision and control over everything entering and leaving the Customs territory．There are some specific characteristics and patterns of its own as far as its law enforcement corruption as well as the prevention are concerned．This thesis，by combining literature research and practical examples，presents a rational analysis as well as practical exploration of customs law enforcement corruption in the aspect of public administration．This thesis，firstly，beginning with the definition of corruption，elaborates on law enforcement corruption and goes further with a definition of customs law enforcement corruption．Then the thesis analyses some new characteristics and forms as well as the root of the current customs law enforcement corruption，which is elaborated in the aspect of human nature for personal gains pursued by some law enforcement officials，absence of rules and regulations，and lack of public administration ethics as well．Finally，by combining macro-aspect and a micro-aspect，the thesis presents some countermeasures to prevent and deal with this problem，which include perfecting customs administrative institutions，improving law enforcement procedures and methods，standardizing individual adjudication of law enforcement officials，reinforcing supervision over law enforcement，inflicting severer punishment on those who commit offense，improving performance of law enforcement officials，and should be paid tO those new characteristics of the problem a
