硕 士 学 位 论 文 汉唐数罪俱发原则的历史考察 The Historical Investigation of the Principle of Commitment of Several Crimes of the Han and Tang Dynasties 作 者 姓 名： 张 莹 指 导 教 师： 胡仁智 西 南 政 法 大 学 Southwest University of Political Science and Law PAGE PAGE 1 内容摘要 在我国古代刑法中，数罪俱发原则的历史非常悠久。法律史学界有学者认为， 中国古代的数罪俱发原则萌芽于西周时期。《尚书·吕刑》中的“其刑上备，有 并两刑”当是二罪俱发原则的最早记录。不过，从《尚书·吕刑》来看，西周尚 未明确使用有关数罪俱发的概念。究竟数罪俱发的概念产生于何时？这一原则的 名称和内容在中国古代刑法中是如何流变的？这是过去一直难以得解的问题。二 十世纪是考古新发现成果累累的时代。云梦秦简、江陵张家山汉简的相继出土， 其中所蕴含的丰富的法律史资料，以及详实可信的证明力为我们深入了解和认识 数罪俱发这一中国古代重要的刑法原则的内涵、历史流变及其内容的发展完善提 供了可能性。因此，本文拟利用出土文献资料与传世文献资料相结合的方法，对 由秦经汉至唐的一人犯数罪问题进行考析，以期对研究法律史的这一基本问题有 所裨益。 全文由引论、正文及结语组成。引论部份主要介绍论文选题意义，同时简要 考证数罪俱发原则的最早记录，并说明本文的研究方法及所使用的资料。正文部 份是文章的主体，由三个大的部份组成： 第一部分，分别介绍了秦律中的一人犯数罪的涵义，汉律中的“一人有数罪” 与秦律中的一个犯数罪的异同以及唐律中的“诸二罪以上俱发”的涵义，梳理了 数罪俱发原则在秦汉唐时期的内涵及发展完善过程，同时就哪些情况适用此原则 量刑进行了分析，还比较了此原则在三朝律文中的异同。 第二部分，介绍了汉律和唐律数罪俱发原则的主要内容，通过对秦、汉、唐 时期的律条及相关案例的细致分析，对各时期刑法中如何适用此原则对多个罪进 行合并处罚的一般性规定和特殊规定进行了说明、分析和比较。 第三部分，总结了汉唐时期数罪俱发原则的历史地位、特点及其深远影响。 关键词：数罪俱发；唐律；汉律；般性规定；特殊规定；区别 Abstract In the ancient criminal law of our country, the principle of several crimes has a very long history. Some scholars of the field of legal history believe that our country’s principle of several crimes originated from the Western Zhou dynasty. The earliest record of the principle is in the book of “Shang Shu”. The record is ‘All punishments and criminals must be recorded in the legal documents’. However, from the record, we can know that there is no explicit concept of several crimes in the Western Zhou Dynasty. When was the concept of several crimes definited? How did the name and content of this principle change in Chinese ancient criminal law. This two problems have been difficult to get solutions. There are numerous new archaeological discoveries in the twentieth century. Shuihudi Qin Dynasty’s Bamboo Slips and Jiangling Zhangjiashan Bamboo Slips have been unearthed in succession.
