- PAGE I - 本科毕业论文 （20 届） 论默示权利 所在学院 专业班级 法学 学生姓名 学号 指导教师 职称 完成日期 年 月 PAGE I 摘 要 【摘要】默示权利是一项推定权利，它是从法律规范、法律原则、法律精神中揭示隐含权利，通过权利推定的方式，确认其法律地位的一种法定权利。默示权利越来越多地被应用到司法实践过程中，它对立法、人权保障、权利发展起到重要。默示权利的产生主要基于人类理性认识的局限性，再加上法律语言的模糊性，法的天然的结构空缺，使得默示权利能够有效弥补明示权利的不足之处。默示权利由权利推定而来，它有多种表现形式，大致可分为由法律规则和法律原则及精神推定而来。法律规则下又可分权利推出权利和义务推出权利，法律原则及精神分一般法律原则和精神及“法无禁止则自由”这一法律精神推定而来。保护默示权利，有利于推动人权保障，维护国家宪政民主，建设现代法治国家，符合社会主义法的保护人民享有最广泛的法的民主精神。 【关键词】明示权利 默示权利 法律原则 权利推定 The Implied Rights 【Abstracts】 As presumed rights, implied rights are presumed from the legal norm, legal principle, law spirit and so on to confirm the legal status and make it a kind of legal rights. Implied rights increasingly being applied to the judicial practice, it is of significantly importance to legislation, human rights and the rights development. Implied rights confirmed on the basis of human conceptual knowledge, the fuzziness of law language, and the open texture of law, supplying a gap between expressed rights. Implied rights confirmed by right presumption, and it has different forms, which can be roughly divided into presumption by the norm of law, legal principle and the spirit.
