PAGE 本科毕业论文 （20 届） 法学 关于工伤认定及工伤待遇的几点思考 关于工伤认定及工伤待遇的几点思考 摘 要：近年来，工伤事故频繁发生，而工伤保险能够最大限度的保护劳动者的合法权益。因此，不断完善工伤保险制度十分重要。新《工伤保险条例》在扩大了工伤保险适用范围、扩大了上下班途中的工伤认定范围、简化了工伤认定、鉴定和争议处理程序、提高了一次性工亡补助金和一次性伤残补助金标准、增加了工伤保险基金支出项目等五点上更进一步，但还有很多地方存在不足，在工伤认定和工伤待遇方面需要进一步改进和完善。文章浅谈了关于工伤认定及工伤待遇的几点问题和一些建议，旨在能够更好的保护劳动者的合法权益，促进社会的和谐发展。 关键词：工伤条例；职工；工伤待遇；工伤认定；工伤保险 With regard to Several Thinking Ideas on the Identification of the Industrial Injury and Industrial Injury Treatmen Abstract:In recent years, industrial injury accidents occur frequently, and the industrial injury insurance can utmost to protect the legal rights of the laborers. Therefore it is of vital importance to constantly improve the Industrial injury insurance system. The new Injury Insurance Regulations goes a step further in expanding the scope of industrial injury insurance and the identification scope during the way between home and office, simplifying the identification of industrial injury and the process of dealing with the controversy, improving the one-time labor to die grant-in-aid and one-time disable grant-in-aid standards, increasing fund of industrial injury insurance spending projects and so on. But there are also many deficiencies in the regulations needed to improve and perfect, for instance, in the identification and treatment of industrial injury. The article talks about several questions and suggestions of the identification and treatment of industrial injury briefly, which aims at protecting workers to have lawful rights and interests preferably and promoting the development of harmonious society.
