AbstractHuman Abstract Human ri#ts is within thejurisdiction ofsovereign state in nature．Since the end ofthe Second World War,the international society began to attach great important to the human rights issues．As a result，treaties(CCPR／CESCR)adopted by systematization of mandatory international human fights protection．Although human rights can be protected at the international level，nation still plays an important role． Freedom ofexpression is one ofthe basic human rights in‘the universal declaration of human fights”．And in ournation freedom ofexpression should be also protected by the rule of constitution and other laws．Protection to freedom of expression involves some essential issues such as freedom of expression’s meaning in international law，the actuality of protection by law in nations ofworld,the relation between national sovereign and the role of internationalhuman rightstreatybodyinhumanrightsprotection． The thesis tries to illustrate these issues through the analysis ofthe international human rights treaty and the law of some nations related to freedom of expression．The first chapter introduces f／eedom ofexpression as one ofbasic human fights，the conception and value of this human rights．The second chapter presents freedom ofexpression’s pmNess and theory． The third chapter analyse freedom of expression’s meaning and factor．The forth chapter focuses on the international human rights protection related to freedom of expression．The filth chapter presents a detail description of the exception and limitation on freedom of expression．The thesis ends wim freedom of expression’s contemporary and tendency in our country,and put forward some suggestion ofprotection to freedom ofexpression． Keywords：i nternat i ona l human r i ghts。freedom of express i on legaI protection 4 引言：《1廿界人权宣言》提出了人权的共同标准， 引言： 《1廿界人权宣言》提出了人权的共同标准， 《经济、社会利文化权利国际公约》 和《公民权利和政治权利国际公约》将其法律化，使缔约国承担实现和保护人权的义 务。我【习虽尚未批准《公民权利和政治权利国际公约》，但认真保障国际人权公约所 确立的基本人权是我国必然的义务，为加入公约而积极应对完善相应的理论和法制， 时问也是相当紧
