内容提要当前，犯罪案件增多与有限的司法资源之间的矛盾日益突出，司 内容提要 当前，犯罪案件增多与有限的司法资源之间的矛盾日益突出，司 法机关办案压力大、诉讼周期长、诉讼效率低下，如何提高司法效率 日益成为关注的焦点，亦成为司法改革的重中之重。辩诉交易一百多 年前起源于美国，在联邦和各州得到广泛采用，并在英美法系国家得 到J一泛运用，它是在特定条件之下才能正常运转的～项制度。本文通 过对辩诉交易产生的条件、运行的基础、具有的优缺点以及我国现阶 段刑事诉讼情况作了简要的介绍，并在此之上对辩诉交易进行了分 析，认为辩诉交易制度中所蕴涵的合理性因素值得我国借箍，我国已 经具有引进辩诉交易制度的前提条件、引进该制度的必要。队、可行性， 并且通过具体案例予以说明。虽然如此，但是我国的实际国情与美国 是不同的，绝对不能全盘照搬，盲目效仿。我们可以从中借鉴和吸收 于己有益的东西。辩诉交易在某些方面有一定的合理性，如何改造吸 收需要进一步研究。应当在一定范围内突破 定的条条框框，在不违 背立法的基本精神和I基本原则的前提下，依据现代法治理念的要求， 进行改革和创耨，积累经验。在对美国的辩诉交易制度进行考察和研 究时，根据其所蕴涵的合理性启示，提出了借以改革和完善我国现行 的若干刑事司法制度的具体设想。 关键词：辩诉交易 自愿 理智 明知 事实基础 AbstractThe Abstract The conflict between the increasing crime cases and the limited ．iudicial resources looms large progressively today．The judicial administrative bureau are facing more problems，such as the great pressure of disposing of cases，the long period and the inefficient proceeding，thus how to improve the litigate efficiency has become a focus that everyone notices and the important part of the judicial reform．Plea bargaining originated in America 100 years ago，and it becomes widespread in the judicial system of both Federal and all the states of the America，and the Anglo—American legal system as well． Plea Bargaining is the system which should work normally in a special condition．A brief account of the Plea Bargaining in producing condition，running basic，advantage and disadvantage and the condition of criminal law suit in our national nowadays stage is included in this thesis，moreover，it is also contain the analysis of the Plea Bargaining which based Oil the above aspects．The reasonable factors of the Plea Bargaining is worth being taken advantage and using to reform and perfect some of our present criminal judicial system for our country．It is necessary for our country to adopt the Plea Bargaining system and OUl。present social environment have the qualification to adopt it。Considering the difference of the practical condition between C‘hina and America，we should use it for reference instead
