关于农村土地制度的立法研究-环境与资源保护法学专业论文.docx

摘 摘 要 现行的农村土地集体所有家庭承包经营制曾经为中国的农业和社会发展撒 出了巨大的贡献，但随着社会的发展变迁，这项制度的弊端日益突显，如何对其 进行变革和完善以符合社会发展要求成为理论界和实践巾迫切需要解决的问题。 本文从变革农村土地利用制度的角度，提出实现土地承包经营权的物权化，即通 过在现有物权法体系中设立农地使用权，并在立法一k对此予以法律制度的确立， 从而达到克服原有制度不足，促进农业发展的目的。 第一部分，从维护农民合法权益、合理利用耕地资源、促进农!眦经济发展等 方面论证了变革农村土地制度的现实意义。 第二部分，介绍了农村土地制度的历史变迁和现行制度的立法状况。 第三部分，分析了现行农村一J-ikfH度在立法上存在的晰多缺陷及对现实造成 的危害。 第四部分，通过对两种农村土地制度变节的思路——变革权属制度或利用制 度的介绍和分析，提出只有变革农村土地利用制度，实现上地承包经营权的物权 化才是符合现实要求的可行性选择，并论证了土地承包经营权物权化的必要性和 可行性。之后，提出实现土地承包经营权物权化的具体途径和办法，即在现有物 权法体系叶I设立农地使用权，建立农地使用权制度。同时，对农地使用权制度的 建立提出一些具体的立法建议。 关键词：家庭联产承包责任制 农地使用权 农村土地利用制度 土地承包经营权物权化 AbstractTile Abstract Tile current household contlact rc,q)onsibility system with reuluncfation linkcd to output made a tremendous contribution to agriculture and economy of China，but its malpractice is getting clear more and more with the development of society．It is pressing problem that how to make the system perfect．The goal of this article is to solve the problem and promote the advance of agricultural production by creating the right to the nse of rural land in law of things． The first part of this article proves the necessity of changing the system of rural land legislation． Thc author introduces the histor，v and the living legislative system of the rural land institution in the second part。 The third part，sizes up the shot tcomings and the harm of this rural land law system ijl the last part．the author makes a suggestion of transforming the system of explointing the rural land by checking the system of ownership against the system of explointment．By building the system of right to the use of rural land to change the system of explointing the I-1．11al land is necessary and passable．The concrete way is creating the right to the ol rutal[antI in the sys|clu ol taw chings． Key words：household contract responsibility system with remuneration linked to output right to the use of rural land the system of explointing the rural land contracted management rights of rural land with the character of the right
